Terms and conditions


This document defines the terms and conditions of use (hereinafter, the “Conditions”) governing access to and use of the web portal Youontour.it (hereinafter, the “Site” or the “Portal”).

Acceptance of Conditions. Access to, navigation of, and use of the Site by any subject (hereinafter, the “User”) imply full and unconditional acceptance of these Conditions in every element. The User is therefore invited to carefully read these Conditions before using any service offered by the Portal. If the User does not intend to accept these Terms, they are requested not to use the Site. Usage of the Site constitutes express and full acceptance of the content of this document.

PURPOSE OF THE PORTAL AND DESCRIPTION OF SERVICES

  1. Objective of the Portal. Youontour.it is a tourist-cultural portal created to enhance and promote the identity, knowledge, and tourist enjoyment of the Agrigento territory. The Site acts as a digital catalog organized into thematic sections, providing:

  • Information on the various attractions of the territory: archaeological, artistic-monumental, and naturalistic assets and places of interest.
  • Informative content, curiosities, and useful tools for autonomous holiday planning.
  • A digital showcase of selected Partners – companies, facilities, products, and useful services – aimed at improving the stay in the Agrigento territory.
  1. Description of Services. The main service of Youontour.it is twofold:

  • Function for the User. To offer the User an easy and targeted search for places of interest and for companies and professionals (the “Partners”) offering services associated with the tourist stay, based on specific needs and search criteria
  • Function for Partners. To facilitate the visibility of Partners operating in the tourism sector through specific dedicated spaces, complete with descriptions, photos, maps, contact details, locations, and promotional proposals. Such elements are provided by the Partners themselves.
  1. Nature of Service and Exclusion of Intermediation. The information and functionalities of the Site are for purely informational and facilitation purposes, and in no case constitute a substitution or intermediation in the direct relationship between the User and the Partners operating in the tourism sector. Any agreement, contract, or condition established between the User and the Partner is regulated exclusively between the interested parties.
  2. Editorial Content. The Portal hosts photos, descriptions, and tourist information, as well as other informative content and curiosities curated by Youontour.it. Regarding such content, it is specified that Youontour.it does not represent a newspaper and cannot be considered an editorial product pursuant to Law no. 62 of March 7, 2001.

ACCESS AND USER OBLIGATIONS

  1. Free and Voluntary Access. Access to and consultation of the Site are free and open to all Users. Use of the Portal occurs on a voluntary basis and under the User’s total responsibility.
  2. Responsibility in Use. The User assumes full and total responsibility for the consequences deriving from any improper or illicit use of the Portal’s functionalities. The User undertakes to use the Site and Services in compliance with the law and these Conditions.
  3. Personal and Contact Data (If Requested). The User assumes full responsibility for the truthfulness, accuracy, and correctness of data voluntarily provided via contact forms, registration forms, or other functionalities present on the Site. The User guarantees that the sent data are reliable, truthful, relevant, and not excessive regarding the Portal’s purposes.
  4. Content and Contributions. The User may contribute to improving the Site solely by sending reports of errors or variations in information via email to info@youontour.it. Sending any other unsolicited content (information, data, images, messages) or content not requested by the Portal’s active functionalities is prohibited.

OBLIGATIONS AND RESPONSIBILITIES OF PARTNERS (COMPANIES AND PROFESSIONALS)

  1. Partners and Content: The insertion of content related to Partner activities (companies, facilities, and professionals in the tourism sector) is regulated by specific agreements with Youontour.it. Partners are required to provide Youontour.it with the material (information, photos, data, promotions) necessary for the creation and updating of their showcase on the Site. The insertion and eventual modification of content on the Portal are carried out exclusively by Youontour.it upon indication and on behalf of the Partner.
  2. Responsibility for Partner Content (Indemnity). The Partner is the sole and exclusive party responsible for the truthfulness, lawfulness, accuracy, and completeness of any content provided, transmitted, or inserted by them on the Portal in relation to their activity. The Partner guarantees ownership of all necessary rights over the provided content and undertakes to indemnify and hold Youontour.it harmless (as well as entities connected to or controlled by it, its representatives, employees, and any collaborators) from any claim, damage, or expense, including legal fees, deriving from: illicit, false, or non-compliant content; violation of third-party rights (including copyright or privacy) due to Partner content; any violation of the rules regulating the use of the Portal.

GENERAL RULES AND ADVERTISING

  1. Rules and Limits of Use. Youontour.it reserves the exclusive right to establish general rules and limits regarding the use of the Services and Site functionalities. Such limitations apply in particular to content provided by Partners (e.g., maximum character count for texts, number of photos, or accepted file types) and are binding for the use of the Portal.
  2. Advertising and Third-Party Links (Outbound Links). The Site may contain advertisements and links to profiles or web pages managed by third parties (“External Sites”). The insertion of such links is carried out exclusively by Youontour.it. However, any relationship or transaction undertaken with the managers of External Sites occurs exclusively between the User and the Third Party. Youontour.it cannot be held responsible for the content, advertising, products, or any damage deriving from access to or use of External Sites.
  3. Links to the Portal (Inbound Links). The User is authorized to cite or refer to the Youontour.it Portal on external resources (such as social media or other websites). However, Youontour.it is in no way responsible for the functioning, content, or advertising present on such external resources.

PROCESSING OF PERSONAL DATA

The collection and processing of personal data of users navigating and using the Site’s services are governed by our Privacy Policy and our Cookie Policy. We invite the user to review them to understand in detail how their data is managed and what their rights are in this matter, in compliance with EU Regulation 2016/679 (GDPR).

LIMITATION OF LIABILITY AND EXCLUSION OF WARRANTIES

The Site and its services are offered to Users and Partners “as is” and “as available” without any warranty, explicit or implied. To the maximum extent permitted by law, Youontour.it cannot be held responsible for any direct or indirect, incidental, special, economic, consequential, or punitive damages deriving from the use or non-use of the Site.

In particular:

  1. Service Availability. Youontour.it undertakes to ensure correct and constant functioning but does not guarantee the absence of interruptions, malfunctions, or technical errors. Technical problems beyond our control may occur (e.g., power outages, natural disasters, network problems, server malfunctions, cyber attacks).
  2. Accuracy of Information. Although maximum care is taken in drafting content, we do not guarantee the absolute accuracy, completeness, or currency of published information, particularly that provided by third parties (institutional, cultural, and commercial partners). The user is required to verify all information (e.g., schedules, prices, closures, rates, tickets) directly with service providers.
  3. Relationships with Third Parties. Youontour.it operates as a digital showcase and not as an intermediary. Any relationship, transaction, or agreement between the user and partners present on the Site occurs exclusively between them. We are not responsible for any non-performance or damages deriving from such relationships.

INTELLECTUAL PROPERTY AND THIRD-PARTY RIGHTS

  1. Ownership of the Portal. All original content of the Portal (including texts, graphics, logos, software, and structure) is protected by industrial and intellectual property legislation and is the exclusive property of Youontour.it. Partner or third-party content is used under concession and authorization from the respective owners.
  2. Prohibition of Use. The User undertakes to respect such rights and, therefore, not to copy, reproduce, modify, distribute, or use in any other way the contents of the Portal without explicit written authorization from Youontour.it.
  3. Respect for Third-Party Rights. Anyone who believes that content published on the Portal is in violation of copyright may report it promptly to the address info@youontour.it to allow for prompt verification and possible intervention.

AMENDMENTS TO CONDITIONS AND COMMUNICATIONS

  1. Right to Modify. Youontour.it reserves the right to modify these Terms of Use at any time. Amendments will be effective from the moment of their publication on the Site. Continued use of the Portal by the User after publication implies full acceptance thereof.
  2. Communications. Any official communication between Youontour.it and the User or Partners must take place in writing. Notifications sent to info@youontour.it will be considered received.

APPLICABLE LAW AND COMPETENT COURT

These Terms of Use are entirely governed by and interpreted in accordance with Italian law. For any dispute arising from the interpretation, execution, or violation of these Conditions, or in relation to the use of the Portal, jurisdiction and exclusive competence belong to the Court of Agrigento (Italy).  If one or more provisions of these Conditions are declared invalid or ineffective by the Competent Judge, the invalidity shall not affect the remaining provisions, which shall remain fully valid and effective.
